These Terms of Use ("Terms") constitute a legally binding agreement between you ("you", "your", "customer" or "user") and NUUR COSMETICS LTD ("Nuur Cosmetics", "we", "us" or "our"), a company registered in England and Wales under company number 14265750. These Terms govern your access to and use of https://nuurcosmetic.com and any associated pages, features, services or applications operated by us (collectively, the "Site"), together with purchases made through the Site.
By accessing the Site or placing an order, you agree to these Terms.
Nothing in these Terms affects any statutory rights that cannot lawfully be excluded or restricted.
1. Agreement to Terms
These Terms apply to all users of the Site.
Our Privacy Policy, Cookie Policy, Return & Refund Policy and any specific terms relating to promotions, guarantees or offers may also apply.
If there is any inconsistency between these Terms and a mandatory right provided to you by applicable consumer law, the mandatory consumer right will prevail.
We may amend these Terms from time to time to reflect changes in law, our business, products or Site.
Revised Terms will take effect from the date they are published and will not retrospectively alter the contractual terms applicable to an order already accepted by us unless required by law.
2. Eligibility and Use
By using the Site, you confirm that:
you are at least 18 years old, or are using the Site with the permission and supervision of a parent or legal guardian;
information supplied by you is accurate and current;
you are authorised to use any payment method submitted;
you will use the Site only for lawful purposes; and
you will not use the Site in breach of applicable laws or regulations.
We may restrict or suspend access where we reasonably believe there has been fraud, misuse, a security risk or a material breach of these Terms.
3. Intellectual Property
Unless otherwise stated, all text, photographs, videos, graphics, product imagery, logos, trade names, trademarks, branding, website designs, software and other content displayed through the Site are owned by or licensed to Nuur Cosmetics Ltd.
You may access Site content for your personal, non-commercial use.
Without our prior written consent, you must not:
reproduce or republish our content for commercial purposes;
sell, license or commercially exploit our content;
use our photographs, videos, branding or trademarks in connection with another business;
falsely suggest an association with or endorsement by Nuur Cosmetics;
systematically extract content or data from the Site; or
reverse-engineer Site software except where such restriction is prohibited by law.
All rights not expressly granted are reserved.
4. Prohibited Activities
You must not:
use the Site fraudulently or unlawfully;
attempt to gain unauthorised access to accounts, servers or systems;
introduce malicious software;
deliberately interfere with operation of the Site;
use automated scraping, crawling or data-mining systems without our written permission;
impersonate another person;
submit deliberately false information;
infringe our intellectual property or the rights of another person; or
use the Site in connection with fraudulent payment, refund, promotional or guarantee claims.
We reserve the right to investigate suspected misuse and preserve information reasonably necessary for the prevention, investigation or defence of fraud, disputes or legal claims, subject to applicable data protection law.
5. Accounts
You are responsible for keeping your account credentials confidential.
You should notify us promptly if you believe your account has been accessed without permission.
We may suspend or terminate an account where we reasonably believe it has been used fraudulently, unlawfully or in material breach of these Terms.
6. Product Information
We take reasonable care to ensure that product information displayed on the Site is accurate.
Product packaging, presentation or appearance may occasionally vary from photographs displayed online, including following packaging updates.
Colours may also vary depending on screen and device settings.
Products must be used in accordance with the instructions and precautions supplied with them.
Cosmetic results vary between individuals. Customer reviews, photographs, testimonials, before-and-after images and other examples describe individual experiences and do not constitute a guarantee that every customer will achieve identical results.
Any claim made by Nuur Cosmetics concerning a product is subject to the wording and qualifications accompanying that claim.
Information provided through the Site is intended for cosmetic and general informational purposes. It is not a substitute for diagnosis, treatment or personalised medical advice from an appropriately qualified healthcare professional.
Customers are responsible for considering ingredient lists and product information before use, particularly where they have known sensitivities or allergies.
If irritation or another unexpected reaction occurs, discontinue use and seek appropriate professional advice where necessary.
Nothing in this section excludes any liability that cannot lawfully be excluded.
7. Orders
Placing an order constitutes an offer by you to purchase the products shown in your order.
An automated acknowledgement, payment authorisation or payment receipt does not necessarily constitute acceptance of your order.
Unless we expressly state otherwise, a contract is formed when we send confirmation that your order has been accepted or dispatched.
We may refuse or cancel an order before acceptance where reasonably necessary, including where:
a product is unavailable;
there is an obvious pricing or description error;
payment cannot be authorised;
fraud or unauthorised payment is reasonably suspected;
an order appears to be intended for unauthorised resale;
promotional terms have been breached;
delivery to the destination is unavailable; or
we are legally unable to fulfil the order.
Where we cancel an order after taking payment and no valid amount remains due to us, the relevant payment will be refunded.
8. Pricing and Payment
Prices are displayed in the currency shown at checkout and include UK VAT where applicable.
Prices and offers may change before an order is accepted.
A change will not affect an order already accepted by us, except where there has been an obvious error which you knew or could reasonably have recognised as an error.
Payment services may be provided by third-party payment processors and their terms may also apply.
9. Promotions and Discount Codes
Promotional codes, discounts, gifts and special offers may be subject to additional conditions.
Unless expressly stated otherwise:
one promotional code may be used per order;
codes have no cash value;
promotions cannot be applied retrospectively;
promotions may be limited by time, customer, territory, product or minimum spend; and
promotional benefits may not be transferred or resold.
We may refuse, withdraw or reverse a promotional benefit where we reasonably identify fraud, duplicate accounts, technical manipulation, deliberate circumvention of promotional restrictions or other misuse.
This does not affect an order already accepted except where the promotion was obtained fraudulently or where applicable law otherwise permits us to act.
10. Personal Use and Resale
Unless we have agreed otherwise in writing, products sold through our consumer Site are intended for personal use.
You must not purchase products for systematic commercial resale or redistribution while representing yourself as a consumer.
We may refuse unusually large, repetitive or otherwise suspicious orders where we reasonably believe they are intended for unauthorised commercial resale.
11. Delivery
Delivery dates and timeframes displayed on the Site are estimates unless expressly stated to be guaranteed.
You are responsible for providing a complete and accurate delivery address.
Once an order has entered fulfilment, we cannot guarantee that an address can be changed or an order intercepted.
Where a delivery fails because you supplied an incorrect or incomplete address, failed to collect a parcel, refused delivery without exercising a valid statutory right, or otherwise prevented delivery, we may recover reasonable costs actually incurred as a result where permitted by law.
Any refund payable following such a return may be made after the parcel has been returned to us or our fulfilment provider and processed.
Nothing in this section permits us to charge amounts that applicable consumer law requires us to bear.
For consumer orders, risk in the goods passes when the goods come into your physical possession or the physical possession of a person you nominated to receive them, subject to applicable law.
Where tracking records a parcel as delivered but you tell us that it has not been received, we may reasonably investigate the delivery with the carrier and may request information reasonably required to determine what occurred.
We will not reject a valid statutory claim solely because carrier tracking records the parcel as delivered.
12. International Orders
International shipments may be subject to import VAT, customs duty, tariffs, brokerage fees, carrier handling charges or other charges imposed in the destination country.
Unless checkout expressly states that these charges are included, they are not included in the price paid to Nuur Cosmetics and remain the responsibility of the recipient.
We do not determine or control charges imposed by foreign governments, customs authorities or carriers.
Customers are responsible for ensuring that products ordered may lawfully be imported into their destination country.
If an international shipment is refused, abandoned, left uncollected or returned because import charges have not been paid, we may deduct from any refund amounts that we are legally entitled to deduct, including reasonable non-refundable costs actually incurred as a direct result of the failed delivery.
Any such deduction will be subject to applicable consumer law.
Original shipping charges, customs charges or carrier fees will not be described as refundable where they are not legally required to be refunded.
Nothing in this section affects mandatory consumer rights.
13. Cancellation of Online Orders
Where you are a UK consumer purchasing at a distance, you will generally have a statutory right to cancel qualifying purchases within 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods.
After notifying us of cancellation, qualifying goods must generally be returned within the legally applicable return period.
Unless we have agreed to pay return costs, you are responsible for the direct cost of returning goods where we have informed you of this obligation as required by law.
Where applicable, we may withhold reimbursement until we receive the goods back or you provide evidence that they have been sent back, whichever occurs first.
We may make any deduction from the value of returned goods that is permitted by law where handling has gone beyond what is reasonably necessary to establish their nature, characteristics and functioning.
Any statutory refund will include the basic outbound delivery charge where required by law, but we are not required to refund any additional amount paid for a more expensive delivery method than our least expensive standard delivery service.
14. Hygiene-Sealed Cosmetic Products
Certain products sold by Nuur Cosmetics may be supplied sealed for health protection or hygiene reasons.
Where a product:
was supplied sealed;
is not suitable for return due to health protection or hygiene reasons; and
has been unsealed after delivery,
the statutory right to cancel may not apply where the conditions of the applicable legal exemption are satisfied.
This is particularly relevant to cosmetic products intended for application around the eyes or other circumstances where resale after opening would not be hygienically appropriate.
Opening outer postal packaging alone does not necessarily amount to unsealing a product for the purposes of this provision.
This exclusion does not affect your rights where goods are faulty, damaged, incorrectly supplied or not as described.
15. Faulty, Damaged or Incorrect Goods
We are responsible for supplying goods that conform to the contract and applicable consumer law.
If you believe a product is faulty, damaged, incorrectly supplied or not as described, contact info@nuurcosmetic.com.
We may reasonably ask you to provide:
your order number;
photographs or video showing the issue;
an explanation of the problem;
packaging or batch information where relevant; and
any other information reasonably necessary to investigate the claim.
A request for reasonable supporting evidence does not remove or restrict your statutory rights.
Your legal remedies will be determined by applicable consumer law.
16. Voluntary Money-Back Guarantees
From time to time, Nuur Cosmetics may offer a voluntary money-back guarantee in addition to statutory consumer rights.
Any such guarantee is governed by the conditions displayed with the relevant offer or in our Return & Refund Policy.
A voluntary guarantee may reasonably require evidence demonstrating compliance with its stated conditions, including evidence relating to product use, duration of use or the claimed result, where such requirements were clearly disclosed before purchase.
Unless the applicable guarantee expressly states otherwise:
it applies only to qualifying purchases made directly through authorised Nuur Cosmetics sales channels;
it may be claimed only once per eligible purchase;
it is personal to the original purchaser;
proof of purchase may be required;
a claimant must comply with the reasonable evidence requirements stated in the guarantee;
duplicate, fabricated, manipulated or fraudulent claims are excluded; and
the guarantee cannot be used to obtain more than the amount legitimately paid for the qualifying product.
We may reject a claim where we reasonably determine, on evidence, that the applicable guarantee conditions have not been met.
Nothing in a voluntary guarantee restricts statutory rights concerning faulty, damaged or misdescribed goods.
17. Refund Abuse and Fraud
We reserve the right to investigate refund, replacement and guarantee requests where there is reasonable evidence of fraud or abuse.
Examples may include:
falsified delivery claims;
manipulated evidence;
repeated claims relating to the same purchase;
deliberate misuse of promotional or guarantee programmes;
falsely claiming that goods were not received;
returning different goods from those supplied; or
seeking reimbursement through multiple mechanisms for the same loss.
We may decline a non-statutory refund, replacement, promotional benefit or voluntary guarantee claim where we reasonably establish fraud or material abuse.
Nothing in this section allows us to refuse a valid statutory remedy.
18. Payment Disputes and Chargebacks
We encourage customers to contact us directly if there is a problem with an order so that we have an opportunity to investigate and resolve it.
If a payment dispute or chargeback is raised, we may provide the relevant payment provider, bank or card scheme with information reasonably necessary to respond to the dispute, including order information, correspondence, delivery evidence and other relevant records, subject to applicable data protection law.
A chargeback or payment dispute does not automatically determine the underlying contractual rights of either party.
We reserve the right to contest a chargeback where we reasonably believe that an order was correctly fulfilled or that a claim is inaccurate, duplicate or fraudulent.
Nothing in these Terms prevents a customer from exercising any right they have to approach their card issuer, payment provider or other legally available dispute mechanism.
We will not seek to recover the same sum twice.
19. Returns
Returns must comply with our Return & Refund Policy and applicable law.
Where the return does not arise from faulty, damaged, misdescribed or incorrectly supplied goods, the customer is responsible for return postage where this responsibility has been properly disclosed and applicable law permits it.
Customers are responsible for packaging returns appropriately.
We recommend using a tracked service because the customer may be responsible for demonstrating that goods have been returned where applicable.
We may refuse voluntary returns which fall outside our published policy where no statutory return right applies.
20. Reviews and Customer Content
If you submit a review, photograph, video, testimonial, comment or other content, you confirm that:
it reflects your genuine experience or opinion;
information presented as fact is accurate to the best of your knowledge;
you have the right to submit the content;
it does not unlawfully infringe another person's rights; and
it does not contain unlawful material.
We may moderate or remove content where we reasonably consider it fraudulent, unlawful, spam, unrelated, abusive or in breach of these Terms.
We will not remove a genuine review merely because it is critical or negative.
Where you separately give Nuur Cosmetics permission to use your images, video, review or other content for advertising or marketing, that use will be subject to the permission or licence agreed with you.
21. Third-Party Services
The Site may contain links to or integrations with third-party websites and services.
We are not responsible for third-party websites, content, systems or privacy practices which we do not control.
The inclusion of a third-party link does not necessarily constitute our endorsement.
22. Privacy
We process personal information in accordance with our Privacy Policy and applicable data protection law.
Where reasonably necessary to prevent fraud, investigate disputes, establish legal claims or defend legal claims, information may be retained and processed as permitted by applicable law.
23. Site Availability
We may modify, maintain, suspend or discontinue parts of the Site.
We do not guarantee uninterrupted availability of the Site.
We may restrict access where reasonably necessary for maintenance, security, technical or operational reasons.
24. Limitation of Liability
Nothing in these Terms excludes or restricts liability where doing so would be unlawful.
In particular, nothing excludes or restricts liability for:
death or personal injury caused by our negligence;
fraud or fraudulent misrepresentation; or
statutory consumer rights or other liability that cannot lawfully be excluded or restricted.
If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill.
We are not responsible for losses that were not foreseeable.
Goods sold to consumers are supplied for domestic and private use unless otherwise agreed.
Where you are purchasing as a consumer, we are not responsible for business losses including loss of profit, revenue, contracts, business opportunity or business interruption arising from consumer use of the products.
Nothing in this section affects your statutory rights.
25. Business Customers
If you purchase products wholly or mainly for purposes relating to your trade, business, craft or profession, you may be treated as a business customer rather than a consumer.
To the maximum extent permitted by law, we will not be liable to a business customer for:

Any commercial resale, wholesale or distribution relationship may be subject to separate written terms.
26. Events Outside Our Reasonable Control
We are not responsible for delay or failure caused by events outside our reasonable control.
These may include severe weather, natural disasters, carrier disruption, customs delays, industrial action, governmental restrictions, war, civil disturbance, widespread telecommunications failure or material disruption affecting essential third-party services.
Where such circumstances affect an order, we will comply with any rights or remedies that applicable consumer law requires us to provide.
27. Suspension and Termination
We may restrict or terminate access to the Site where reasonably necessary because of:
material breach of these Terms;
fraud or suspected fraud supported by reasonable grounds;
unlawful activity;
abuse of our systems, promotions or guarantees; or
significant security risks.
This does not affect contractual or statutory rights arising before termination.
28. Governing Law and Jurisdiction
These Terms and contracts entered into through the Site are governed by the law of England and Wales.
If you are a consumer, this choice of law does not deprive you of mandatory protections that apply to you under applicable law.
Consumers may bring proceedings in any court in which applicable law permits them to do so.
If you are acting in the course of a business and not as a consumer, the courts of England and Wales will have exclusive jurisdiction unless we agree otherwise in writing.
29. Complaints and Dispute Resolution
If you have a complaint, please contact us first at info@nuurcosmetic.com and give us a reasonable opportunity to investigate.
Where applicable law requires us to provide information about an Alternative Dispute Resolution body or dispute-resolution procedure, we will provide the required information.
Nothing in this section restricts a consumer's right to pursue a remedy through a court or another mechanism available under applicable law.
30. Severability
If any part of these Terms is held to be unlawful, invalid or unenforceable, that provision will be treated as modified to the minimum extent necessary or, where modification is not possible, severed.
The remainder of the Terms will continue in effect.
31. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean we have waived the right to enforce it later.
32. Third-Party Rights
Except where expressly stated otherwise, a person who is not a party to the contract between you and Nuur Cosmetics Ltd has no right to enforce these Terms.
33. Entire Agreement
These Terms together with any policies or specific terms expressly incorporated into them govern your use of the Site and purchases made through it.
If you are a consumer, nothing in this clause excludes or restricts any representation, right or remedy that cannot lawfully be excluded.
34. Electronic Communications
We may communicate with you electronically in connection with orders, accounts, customer service and legal or administrative matters.
Transactional communications necessary to fulfil or administer an order are separate from marketing communications.
Marketing communications will be handled in accordance with applicable privacy and electronic marketing law.
